MARKETPLACE RENTAL TERMS & WARUNKI
These Terms govern all vehicle rentals facilitated through the Marketplace Platform (“Platform”). Vehicles listed on the Platform are supplied by independent Rental Partners (“Partner”). By confirming a booking, the Renter agrees to these Terms.
1. Role of the Platform
1.1 The Platform acts solely as an intermediary connecting Renters with independent Rental Partners.
1.2 The rental agreement is concluded directly between the Renter and the Partner.
1.3 The Partner is solely responsible for vehicle condition, insurance, dostępność, documentation, pricing accuracy, and compliance with national regulations.
2. Rental Price & Kropka
2.1 All prices are displayed in EURO (€).
2.2 The rental period is calculated on a 24-hour basis from the vehicle pick-up time.
2.3 Delays of up to 1 godzina may be tolerated without additional charge.
2.4 Delays exceeding 2 godziny will incur a charge equal to one full rental day.
3. Zasady płatności
3.1 Rental payment is required 100% z góry upon contract signing or booking confirmation.
3.2 Accepted payment methods include:
• Cash
• Visa
• Visa Electron
• MasterCard
• Maestro
3.3 Card payments are subject to a 4% processing fee.
4. Gwarancja depozytu
4.1 A refundable security deposit ranging from €0 to €250 may be required depending on vehicle category and Partner policy.
4.2 Deposits may be paid in cash or by credit/debit card.
4.3 Card deposits are subject to a 4% processing fee.
4.4 Deposit refunds are processed after vehicle inspection at return.
5. Cancellation & Reservation Policy
5.1 Free cancellation with full refund applies:
• Up to 48 hours before pickup (regular season)
• Up to 7 days before pickup (high season)
5.2 Reservations may be modified up to 48 hours before rental start.
5.3 Minimum rental period is 3 dni during lipiec, sierpień, December and January.
5.4 Bookings below minimum rental period may be cancelled.
6. What the Rental Includes
• Third-party liability insurance at the highest coverage rate
• Unlimited mileage
• Location fees
• 24-hour roadside assistance
• VAT and local taxes
7. What the Rental Does NOT Include
• Fuel
• Traffic fines (Driver fully liable)
• Administrative fine handling fee: €15 per fine
8. Vehicle Pick-Up & Delivery
8.1 Vehicles are normally delivered in Saranda, Ksamili, Tirana International Airport and across Albanian towns.
8.2 Delivery to other locations or border crossings is available for an additional fee.
8.3 Vehicles rented or returned outside Partner offices may incur relocation charges.
9. Vehicle Inspection & Damages
9.1 Vehicle condition is recorded at pick-up and return.
9.2 Damages not covered by insurance and caused by the Renter must be paid immediately.
10. Vehicle Condition & Technical Requirements
All vehicles:
• Pass technical inspections
• Are insured
• Include mandatory safety equipment
• Are equipped with air-conditioning and safety systems
11. Renter Requirements
11.1 Driver age: 21–65 years (exceptions may require higher deposit).
11.2 Minimum 2 years driving experience wymagany.
11.3 Valid passport and driving license required.
11.4 Non-Latin licenses require International Driving Permit.
11.5 Additional drivers must be registered in the rental contract.
12. Technical Problems & Assistance
12.1 In case of breakdown, Renter must contact emergency numbers listed in contract.
12.2 Minor repairs may be reimbursed upon invoice submission.
12.3 Major breakdowns will result in vehicle replacement.
13. Ubezpieczenie & Protection Plans
Optional coverage packages may reduce financial liability.
• CDW – Collision Damage Waiver
• TP – Theft Protection
• CDW+ – Reduced excess coverage
• WUG – Wheels, undercarriage and glass protection
Standard insurance excess: €750 (all categories).
Failure to obtain police report invalidates coverage.
14. Accidents & Theft Obligations
In case of accident or theft, Renter must:
• Secure the vehicle
• Call police
• Collect witness information
• Inform Partner immediately
15. Costs Not Covered by Rental or Insurance
Includes but not limited to:
• Personal belongings loss
• Traffic/parking fines
• Wrong fuel usage
• Lost keys (€300+)
• Lost documents/plates (€150)
• Interior damage
• Negligence
• Alcohol/drug use
• Off-road misuse
• Racing/sport use
• Unauthorized drivers
• Misuse or overload
• Extraction from inaccessible areas
• Roof luggage damage
16. Cleaning & Smoking
• Normal cleaning fee: €10
• Special cleaning fee: €60
• Smoking penalty: €60
17. Prohibited Use
Vehicle may not be used:
• Outside Albania without written permission
• For illegal purposes
• Under influence of alcohol/drugs
• For racing or competitions
• For towing or pushing
• On unpaved roads
• To carry hazardous materials
• By unauthorized drivers
Subleasing is strictly prohibited.
18. Vehicle Return & Repossession
18.1 Vehicle must be returned on agreed date and location.
18.2 Late or improper return voids insurance coverage.
18.3 Partner may repossess vehicle without notice if contract terms are violated.
18.4 Personal items left in vehicle are not Partner responsibility.
19. Vehicle Model Disclaimer
19.1 Displayed vehicle models are for illustrative purposes only. A similar vehicle within the same category may be provided depending on availability.
19.2 Vehicle photographs displayed on the Platform are provided by the Rental Partners. The Platform is not responsible for minor visual differences between photographs and the actual vehicle supplied.
20. Partner & Platform Liability
20.1 Each Rental Partner operates as an independent service provider and bears full responsibility for the rental service provided to the Renter.
20.2 The Partner is solely responsible for ensuring that its business is properly registered with the relevant tax authorities and complies with all applicable fiscal, prawny, and regulatory obligations in the country of operation.
20.3 The Partner assumes full legal and financial responsibility for:
• Vehicle safety and maintenance
• Insurance coverage
• Pricing accuracy
• Taxes, fees, and fiscal reporting
• Compliance with transport and commercial regulations
• Claims, damages, penalties, or legal disputes arising from rental operations
20.4 The Marketplace Platform acts solely as an intermediary and shall not be held liable for Partner-related service failures, accidents, damages, cancellations, tax matters, or legal disputes.
20.5 Any dispute regarding vehicle condition, deposits, damages, fines, service quality, or legal responsibilities must be resolved directly between the Renter and the Rental Partner.
21. Data Protection
21.1 In order to complete the reservation and rental process, the collection and processing of certain personal data is required. Providing the requested information is mandatory. Failure to provide accurate and complete information may prevent the proper execution of the rental service.
21.2 The Rental Partner and/or the Marketplace Platform, acting as Data Controller(s), shall process personal data solely for the purposes of:
• Reservation management
• Vehicle rental and leasing operations
• Customer support services
• Legal and administrative requirements
• Marketing communications (where permitted by law)
21.3 Personal data shall be processed in accordance with applicable data protection legislation and shall not be disclosed to unauthorized third parties.
21.4 The Renter has the right to request access to their personal data and may request correction, updating, restriction of processing, or deletion of inaccurate or unlawfully processed data.
21.5 Requests related to personal data may be submitted to the Data Controller using the contact details provided in the rental agreement.
21.6 The full Privacy Policy governing data processing practices is available on the Platform website.
22. Acceptance of Terms
By confirming a booking, the Renter accepts these Terms and Partner-specific conditions.
Ochrona danych
- W trakcie wykonywania procesu wynajmu, konieczne jest zebranie niektórych danych osobowych. Podanie wszystkich wymaganych informacji jest obowiązkowe. W przypadku braku takich informacji, [Wypożyczalnia samochodów] (Administrator danych) nie będzie w stanie poprawnie przetworzyć Twojego wynajmu. Administrator danych wykorzysta Twoje dane osobowe, aby pomóc Ci w rezerwacji, najem, oraz leasing pojazdów i do celów marketingowych.
- Możesz poprawić błędy rzeczowe w tych danych lub skorzystać z prawa dostępu, aktualizacja, lub usuń dane osobowe, wysyłając zapytanie do administratora danych, korzystając z danych kontaktowych podanych w umowie najmu, którą podpisałeś przy odbiorze pojazdu. 23. Partner Booking Acceptance & Contractual Responsibility
23.1 When a Rental Partner accepts a booking request or receives a booking confirmation through the Marketplace Platform, the Partner enters into a direct contractual relationship with the Customer.
23.2 The Partner is solely responsible for delivering the rental service in accordance with:
• The terms stated in the booking confirmation
• The price specified in the Partner’s listing
• The conditions described in the vehicle listing on the Platform
23.3 By accepting bookings through the Platform, the Partner agrees to pay the applicable commission fees for each completed booking.
23.4 The Platform is authorized to deduct commission fees directly from payments made by Customers through the Platform, unless an alternative payment arrangement has been agreed in writing.
23.5 Any additional terms or supplemental agreements between the Partner and the Customer shall be valid only if:
za) They are fully consistent with these Marketplace Terms & Conditions and Platform Policies; i
b) They are clearly and prominently disclosed in the Partner’s listing description prior to booking.
23.6 The Platform shall not be held liable for disputes arising from undisclosed or conflicting Partner terms.
